Guide: Design infringement case closed with high-priced damages.
 

Brief: Panasonic Corporation owns a design patent of a “Beauty Device”. The beauty device embraces great popularity among consumers due to its novel and fashionable appearance. Numerous companies produce counterfeits of the beauty device. We represented Panasonic Corporation in the infringement lawsuit filed before Beijing Intellectual Property Court with regard to a steam beauty device product produced by a Chinese company, claiming damages of 3 million yuan and an additional 0.2 million yuan of reasonable expenses. The courts of first and second instance both made a decision of infringement affirmation, and supported our claim of 3.2 million yuan damages in full. The damages in this case is, by far, the highest among all design infringement cases processed before Beijing Intellectual Property Court. This case has been successively selected as Top 10 Typical Cases of Intellectual Property of Protection of Beijing Courts in 2016 by Beijing Higher People’s Court and Top 10 Typical Cases of Intellectual Property of Protection of Chinese Courts in 2016 by the Supreme People’s Court.
